Parking Policies

All parking spaces within the Mountaingate Homeowner’s Association are common property. The Board of Directors has the authority to establish rules for use and assignments.   The following updated rules are effective Nov. 1, 2006.

1)     Each townhouse with all fees currently paid in full, shall have two parking spaces assigned for their use solely as a privilege. The use, of these spaces, may be determined by the homeowner as long as these rules are followed.   However, the HOA has the right to revoke the parking privilege of anyone that constantly abuses these rules or their operations.

2)     Violation of any of these rules shall be reason for towing the vehicle at the expense of the owner, with no further notification necessarily given to the vehicle owner/driver.

3)     No vehicle shall extend more than six inches over the sidewalk when headed into or backed into a space, and no vehicle may extend more than six inches past the end of the white lines (into the street) that define the parking space. No vehicle may be parked over its white line into any portion of a space assigned to another homeowner, or into a non parking area.

4)     Residents, including their visitors, are not allowed to park in another resident’s parking space without their written permission.   Should a resident find another vehicle in their parking space, without their permission, they may have the vehicle towed. This may be accomplished by calling Alley Cat Towing  (contactus@alleycattowing.com 301-864-0323) and providing them with the space location number, vehicle description (color, make, model), tag number, and the name of the person requesting the vehicle towing.

5)     Parking spaces are restricted to the parking of licensed and insured motor vehicles only, and are never to be used for children or adult playing; nor the storage or parking of not licensable motorized items (scooters, moped, ATVs, etc.) or any other type of unlicensed vehicles, or other items of any type (toys, bicycles, grills, furniture, tools, etc.).

6)     Failure to keep their HOA Dues currently paid in full will lead to revocation of parking privileges for the spaces assigned to that residence in accordance with the established HOA dues collection policy.

7)     When parking privileges, for a residence, have been revoked for failure to pay HOA Dues, or abuses as outlined in the Covenants and/or these rules, these spaces may not be used by anyone until notification is received in writing that the parking privileges have been reinstated.  When the Parking privileges are revoked, the space numbers are provided to the towing company who will routinely patrol our community and tow unauthorized parked vehicles with no further notification given to the offender.

8)     NEVER ALLOWED at any time are vehicles that are: not licensable, unlicensed, without current registration and/or tags properly displayed, in a condition so as not to be currently moveable under their own power, under major repair or overhauling, having oil changed.   The homeowner is solely responsible for any damage to pavement caused by leaking gas, oil, or abusive actions.   Parking is never allowed on sidewalks and/or common grounds not specified for parking.

9)     Any vehicle that will not pass a Maryland Vehicle Inspection and/or having a condition such that a Maryland Police Officer could issue an equipment repair citation cannot be parked in Mountaingate HOA parking spaces longer than 14-days from the issuance of this said repair citation and/or the issuance of a repair notice from the Mountaingate HOA.

10)  No commercial vehicle(s), or vehicle(s) with a capacity of over 1-ton, are to be parked within this residential community. The only exception to this is a delivery type truck or van making a short-term pickup or delivery during daylight hours only.   For the purpose of these Parking Rules, Commercial vehicle(s) are defined as those that:

  1. Display a clearly visible commercial logo and/or designation (such as name/location/phone number).
  2. Appear to be commercial from their size, shape and appearance.   Examples include but are not limited to: exterior visible ladders, ladder racks, obvious shelving inside visible from outside – that has parts or equipment on them, and/or splashed paint of various colors on vehicle.

11)  No resident, for any reason shall park in any of the visitors spaces – remember that towing is enforced even to residents.

12)  Visitor parking spaces may only be used by non-residents and only while guest of residents in this community.   It is most important to fully understand that Maryland State Law describes a resident as someone who is present for more than 14 straight days or more than 30 days within 12-months. It is the responsibility of the homeowner and/or resident to inform their visitor(s) of these rules since towing is enforced with no further warning. Furthermore, the homeowner and/or resident are held responsible for the actions of their visitor(s) to comply with all behavior and operational requirements.
